Is it possible to overcome Bethesda's rights?

Things in original Fallout 1/2 moved in territory of the North America, but what about other areas of globe? What at the same time happened there? I think this can be a subject of new game in Fallout style. As things move in other territory, they can be not connected in any way with events of original Fallout 1/2 (except the war and the time (2160 - 2250)). Therefore there can bo no names that break rights of Bethesda (e.g. Brotherhood of Steel, VaultTec etc). The S.P.E.C.I.A.L. system can probably be improved/changed somehow and named differendly, so that not to break the rights of Bethesda. Eventually, if once it had been developed, why it is impossible to make similar now? I think that gamesas could use this idea for a new game in Fallout style, with the same atmosphere, a fascinating story, quests etc., and this won't break rights of Bethesda. Am I wrong? Your thoughts?

It would be cool, I guess. But I'm going to assume it wouldn't be allowed.

But I always did wonder what happened, if anything happened, to the other countries such as in Europe.

But I guess we'll never know :( War... War Never Changes...
