Accidentally.

There should really be some kind of command/key/button to enter 'stealing' mode. You have no idea how many times I've accidentally stolen something and been thrown in jail for it.

Guard: 'Stop! You there!'
Me: 'Uhm, sorry officer, I have this syndrome where I mean to talk to someone but I end up stealing their stuff instead.'
Guard: '...' Beat. 'In jail with you!'
Me:

Yep. I've clicked plenty of things that I didn't mean to take. I do think there should be a "nice" filter that allows you to turn off stealing for a bit so that you don't accidentally do it.

Hehe, I've actually accidentally attacked someone too, I sooo thought whirlwind sprint was active! I swear!

I learned this lesson in Oblivion. So far, I've been very careful. Even in stores where 80% is takeable and the rest is not, I get every legal item and nothing else.

I have 5 bounty, alas. It saddens me. It was from when I ran into some bandits fighting horses (WTF?). I think I accidentally killed a horse in my effort to kill a bandit.

And I'm not counting crimes I reloaded for...lots of friendly fire incidents, followed by reload or suicide by cop. The horse wasn't worth reloading for. Poor fella.

Oh yes, and accidental shout assaults from my cat hitting the button or setting the controller down too hard. "Oops...sorry..."

Hahah, you can steal things even if you're not sneaking. If you could only steal in sneaking mode, that would be good enough, I guess.

yea, i do think it's a little exaggerated to throw someone in jail for putting their hands on you, if you didn't steal anything, than how can they prove it, there is no evidence. then people get into fist fights and people gather around and start to cheer, what?
