Has anyone either uninstalled the day one patch (then d/c from the internet to stop it downloading on game start up again)

OR

Returned their disc to the store for a replacement?

Is it even possible for these frame rate / stuttering issues to affect some discs and not others, or does the manufacturing process not work like that?

Would be interested to hear if either of these things have worked at all for anyone.

Actually, I've been seeing all of those things listed being described on these forums. I've seen users report that they returned a disc they were having trouble with and got a new one that worked leagues better. I've seen users delete Game data and the patch and reinstall it, which resulted in better play (or worse, in a few cases). The problems that are occurring are just to chaotic, as seemingly random actions seem to fix certain bugs.

I've been trying to ask the same, apparently the ones unaffected are the minority, a rare instance in which the game functions perfectly fine. I myself have had no trouble but im under the 6000kb part. As for the patch, yes people have been trying by uninstalling everything and such but no results, sometimes it's even more unstable. Best bet is to wait for bethesda to fix this, IF they ever do

I uninstalled the patch and am playing without it, even though my save game is at 9.2mb I am having WAY less lag then I had before, almost as if I was back to 5mb.

Really people, the game is buggy, has very poor AA which blurs everything, suffers from memory leaks, dynamic texture rendering issues, and is clearly not optimized at all, let alone for the PS3. This is why we are all having problems. Returning your game is not going to help. In fact, I will go so far as to say, never in the history of gaming has a disk that actually plays the game been bad. If the disk was bad, the only symptom would be that it would not run at all. Trust me, they are all the same.

I hope your right, because 1. They probably wouldn't let me replace it and 2. I'd feel like a tit asking

It does seem though, as a digital format a disk would either work or not work. there would be no middle ground like a vinyl record, vhs tape etc....hopefully...
