If Patch Doesn't Fix FPS can I Get Faulty Product Refund

I bought mine from Tescos who might allow me to swap for MW3 or Uncharted3 or even Dark Souls(loved Demon Souls) if this patch doesn't fix the only real (at the moment) game breaking bug ......performance.

Even if you can reset your PS3 and get it to a level that is tolerable and even enjoyable, it is still disappointing that at best it still splutters and chops along occasionally freezing when the Xbox has good and constant FPS.
Why make the PS3 version V-Sync and drop frames but not the Xbox??? not just to make the Xbox look better??? they must have tested it with and without and compared it to the Xbox?

Developers have admitted its harder to develop games on the PS3 compared to xbox, hence the xbox is often the lead platform for games.

Its not the first cross platform game to have issues because of this, and wont be the last

If they can't do it properly, then don't. No need in tricking customers into paying $60 for a broken product. Just make it Xbox/PC exclusive and stop making customers and fans waste money and time.

I'm sure, given a choice, the vast majority of PS3 owners would rather wait a couple of weeks for their version to be patched than not be able to play the game at all.

I would much rather have known it was the [censored]tier version so I could've bought it for the 360. I got it for the ps3 so my roommates could play MW3 on the 360 while I holed up with Oblivion.

It's pretty common knowledge that Bethesda is better with the 360 and that PS3 tends to be shafted when it comes to playability and DLC. Not trying to be a Bethesda apologist because it's something I'm not particularly happy with, I'd rather play stuff like this on PS3 given the choice, but unfortunately it's how things tend to work. Might be worth reading up on things like this in the future, save yourself the fuss of getting the dodgy version and having to wait for a patch or replace it.

I agree with you, if you can't do it don't bother. Other games (not all obviously) seem to go across platforms nicely. I have both a PS3 and an x-box but I much prefer my PS3 and only buy exclusive to xbox games for my xbox everything else I buy on PS3.

Oh and to the original poster, I would also like to know if I could return it as a faulty product if it doesn't get fixed, I am sure I could find another game I don't have instead (although it would sadden me to get rid of Skyrim since I was really enjoying it)
