I have been playing since December 2011. I never went after the treasure maps but my current character has 2 maps. Can you find a treasure if you do not have the map in your inventory or discovered the map? I randomly find stuff all the time since I stay off the main trails as much as I can.

No. The chests are created when you come into possession of the maps.
