A question on souls.

Ok, so recently, after doing the Azura's Star quest, i had a thought... who or what defines that a soul is white or black? i searched and found little, not much mor ethen this from the Elderscrolls wiki

"Black souls are those of sentient, humanoid beings such as http://elderscrolls.wikia.com/wiki/Imperial_(Skyrim_race), http://elderscrolls.wikia.com/wiki/Argonian_(Skyrim), and http://elderscrolls.wikia.com/wiki/Dremora, while white souls are those of animals and certain lesser http://elderscrolls.wikia.com/wiki/Daedra. All black souls are of the Grand level. http://elderscrolls.wikia.com/wiki/Nelacar can transform the http://elderscrolls.wikia.com/wiki/Azura%27s_Star_(Skyrim) of http://elderscrolls.wikia.com/wiki/Daedric_Princes http://elderscrolls.wikia.com/wiki/Azura, into a black soul gem with unlimited uses."

Humanoid souls are black? but why? what makes them any different then any other?

I ask because i noticed, that there are 3 creatures in the game that should fit the "Humanoid" label when it comes to their souls, but dont.

1.Giants - basiclly a very large human. they have shown, intelligence, ownership, communication and artistic capabilities.. and have similar featuress to some mer races.

2. Hagravens - if their legend holds true, they we're once witches, thus, if each one was transformed into the hagraven, would still be considered a humanoid soul, would it not? or does the act or ritual of becoming the hagraven deform and distort thier very soul as well?

3. Falmer - has their regression/evolution somehow changed the nature of their souls? they are the living legacy of a Mer race, twisted and malformed by their fate, but would that cause the quality of their souls to change as well?

So what is it? what sets the races of Man and Mer apart from those three?
