Certain elements of Oblivion item scaling?

It just occurred to me on my last playthrough that while Skyrim is Streets Ahead ™ of Oblivion on the level scaling front, there are some goofy elements that remain.

Example: Every damn thief or mercenary I come across after level 50 is decked out in either full glass armor or ebony armor respectively.

Anyone else notices this? It just seems rather odd to give everyone else better stats/levels, yet these two random encounters have such high level "fat lute."
