Question about car insurance.

No sure if this is the place to ask, but my question is such a specific one that I cannot find the answer on google. I deliver Pizza at Pizza Hut, the other day my vehicle hit a customers garage. I thought I shifted the vehicle into park, it turns out the vehicle was still in drive and it crept forward and hit the garage. The owner of the garage said the repair is estimated at 6000 dollars. My insurance company is telling me since I do not have a commercial policy they are not liable to cover the cost. The agent did tell me that pizza hut will probably cover the damages. He said he has had multiple cases where a person is told their company will not cover the damages but they speak to a corporate manager and the company ends up covering it. My question is what happens if Pizza Hut wont cover it? I don't have 6000 dollars and I barely clear 10000 in a year. What will happen? How can I pay these people for the damages? I can't take out a loan because of lack of credit otherwise I would look into that option. Are there options for people in my position? Is it possible that I can get jail time for this? That is my biggest fear. I'll pay money for the rest of my life but I am afraid of going to jail.

I can't see how any damage to a garage door could cost $6,000. Unless you hit the structure on either side of the door. An entire garage door is $300 to $800 to replace, unless it is a custom wood one. And, that type could be repaired. So, get your own estimates if it comes to that. If all that was bent was one panel, then it could even be less money. I should know, I have backed into my garage door and it cost less than $200 to fix it, but I have a cheap contractor grade door that comes on new build houses.

However, I would ask a lawyer about this, but Pizza Hut should be liable for anything it's employees do when they are on the clock.

$6000 for a garage door? What the hell is it made out of, 24-karat gold? Sounds to me like someone's trying to rip you off.

I must not of been specific. The vehicle hit the frame on the side of the door. Not the door itself but the frame next to it. When I looked it looked like it was just a dent in the metal trim around the edge of the door. I called my mom and she told me to get two people to do estimates. It sounds to me like they are trying to get a whole new garage out of it. That seems to be about the cost of a new garage. She claims it warped the frame of the garage. My car literally idled into the garage, there was no incline to make it go faster either.

Sounds to me like the homeowner is attempting insurance fraud. I'd definitely get my own estimate for repairs. But as for the insurance part of it the agent is correct. Since you do not have commercial insurance in your car they are not responsible for covering the damages. Pizza Hut "should" cover the damages but they also don't have to. So it could fall on you.

Ok I talked to her some more. The Garage is an attached garage. Apparently a load bearing wall got warped and part of the garage got pushed off the foundation. All according to her and her 3 estimates.

Yeah, imma call [censored]. The only way a load bearing beam was "warped" and the garage was knocked off it's foundation was if the car hit it at speed. Do yourself a favor get your own estimates for repair and lawyer up.

What do you mean by "crept forward" in your op?

Was the load bearing wall already warped which made it easier to push off the foundation? Did you actually do any of that damage? This damage could have been there well before you came along, you're just going to be the one to fix it... be careful with what they claim, get your own estimates.

You would be surprised at how little force it can take to do that kind of damage. The integrity of the structure plays a big part and we don't know how poorly this house may have been built. Other factors like the house's age and therefore any concrete/wood degradation and termites can play a part as well. I have seen a load bearing beam break in half with a drunken pseudo-karate kick in a very old house before...

But you're also correct in the fact that this homeowner's insurance will try to take him for everything he has if they are able to whether the damage is really that extensive or not.
