I wonder how it still exists after so long.
Bethesda is either unwilling or unable to fix it.

It doesn't. Especially when it's a known issue from previous games on the same engine. They've known about it for years so they either can't or won't fix it. In either case it's pretty cynical of them to continue to release games on the PS3 with this known game-breaking bug in them.
