Recently, there have been several Youtube accounts that have been hit with copyright claims by Zenimax for posting game-play of Fallout New Vegas. First of all, this makes little sense since publishers and developers own the software of the game but most certainly do not own any and all possible game-play that the software creates as that is unique to each individual player of the game. Most U.S. courts would not have a hard time in making this distinction. However, filing claims on Youtube takes advantage of a poorly designed automated system on Youtube that can result in deleted accounts (some of which are very important to the users) without any human confirmation whatsoever. It is a disturbingly selfish business practice, not to mention an inept one considering that any videos of walk-throughs or general game-play would be promoting the game (assuming the product is one of which the developers are proud and confident that the game itself is good enough to appeal to consumers) and could be seen essentially as free advertisemant.

So my question is, are the people at Zenimax/Bethesda softworks capable of making such maladroit business decisions? Or is someone falsely posing as them making these claims?

The game isn't out in tons of countries man, your releasing pre release video that's not authorized, do so on a private channel.

It is not "pre-release video" where it is uploaded from. Which law is it that bans the sharing of any game information until the games final world release date? And if such a law exists, which I doubt, then why doesn't Zenimax file claims against all content related to it throughout the internet. Ex. fallout.wikia.com which has posted plenty of information/spoilers about the game. Or even this forum itself, which has plenty of them in it's own right.

I was actually just guessing probably should have said that, I'd imagine still though that that's what it is.

How to you figure a game that was release in the US in the 19th, Asia/Pac on the 21st and EU on the 22nd is not released yet?

You might be right about that being part of the reason. However, the point is more about them not necessarily having the legal rights to the video but making the claim anyway in order to take advantage of a flawed automated system

I wouldn't be surprised if this is their attempt to get all the glitch footage removed so potential customers who haven't bought the game yet won't be put off and not buy it at all. I seriously think this will be the last Bethesda product I buy, probably Obsidian too. I am extremely disappointed with the state in which this game was released. It's almost unplayable due to the sound lag issue alone, which is the only one I have. Its either play with no sound, press escape then click continue every 2 seconds, or ctrl+alt+delete and set New Vegas' process to above normal priority, which makes the game highly prone to stalling and seemingly getting worse. So much so now that I spend as much or more time stalled than actually playing.
