Console users rest assured; the game runs 60 fps 99% of the time.
As for those asking for video credibility, they simply record it with an HD PVR (external device that captures direct input to the TV) and run it through a software that compares the frames in the videos.
Simply put, if in a second in a video has 56 unique frames, the framerate is obviously 56 fps (for that particular second).
Not quite sure how they measure tearing but it seems to work fine anyways.
