So, apparently someone was fined from getting an early copy of mw3

A claim of a $5000 fine. Who could have fined this person?

Because the ones that are being sold/shared before official release date are pirate copies. Fine is propably for sharing the copy.

The person said not to buy it early. So I think he bought it and got caught

Who would actually hand out the fine?

Not all copies sold/played early are pirated copies

Here http://www.geeksailor.com/modern-warfare-3-torrent-piracy-activision-fine/

I wouldn't give em back the disk, unless they paid me for it.

I wanna know what the fine was for, because I wouldn't siggtake that fine for no reason

Had a friend tell me that works in retail if a company sells a game early they can get some hefty penalties levied against them. Don't remember why exactly but game companies want their game to be released on the same day all across various stores. You get a copy of the game early then people will suspect you of getting a pirated copy or stealing it though he may have bought it legitimately and the game company is PO'd at him.

Not an assumption I'd make. Since I'm a gamer, I already know not to jump to the conclusion of a pirated game.

The stores can get penalties.. like never getting anything from that manufacturer/developer/publisher for a period of time, get leftovers of products in demand, etc
