There MAY* be a settlement in the works as I have suggested from the Court of Appeals link by Austin. The above is the detail though there is not much of it there. I wonder what the deal will be? Agent C (the author of the above) will be updating as necessary with Q&A from him. There are also Q&As from our very own Austin.

Its a safe bet that a settlement is in the works. Bethesdas motion to seal is an indicator.

Will this settlement work in favor of FOOL being produced??

Too early to say since no information is available. It can really go any way depending on where the case was when the settlement talks were put on the table.

I don't think we'll know anything at least until later next week, once the Holidays are over. Lawyers and Bankers and both lax about holidays and vacations. :roll:

I hope so. As I have said, my ultimate scenario would involve Bethesda keeping the rights to the Fallout franchise and gamesas still being allowed to release Fallout: Online.

I do think that Bethesda would be unlikely to put forth a settlement that did not involve the latter happening, because gamesas would be unlikely to accept it and I think Bethesda knows that. Maybe this settlement will mean we have the compromise I have been rooting for this whole time. I certainly hope so.

I have been thinking of that for a couple years now. I have nothing against Bethesda, I enjoy their products. The best ending for all of us is if BOTH companies win, because that means more fallout for us.

But I would _personally_ want to see gamesas get a 25-50 million settlement offer to cover the costs of this debacle and to fund PV13. Maybe Bethesda would offer them that kind of money in exchange for a 20% of sales? I don't know, theirs so much information unavailable in this case it would be purely speculation. But if they were to offer a substantial settlement as I stated, then that would mean Bethesda would be an investor because they are doubling the budget for the game and it's win win for them because the end product will not reflect poorly on the whole fallout franchise. Again, pure speculation and personal wants.


I just don't want either side to lose because as I said I enjoy anything fallout. I don't know if anyone follows Obsidian but Tim Cain finally went full circle and is now back their with Avellone as of october 2011. I'm a huge Tim Cain fan so him joining up a couple months ago right before Skyrim (with it's new engine) tells me 100% for a fact we will be seeing a new fallout game by either october 2012 or march 2013.

Why march or october? Well ES4 was march 2006, Fallout 3 october 2008, FONV october 2010, ES5 was supposed to be march 2012, but was released early to hit the holiday sales (which was a brilliant move, I think skyrim has made at least 1 billion in revenue so far)

I'm certain that's the next fallout they are talking about, based on what I wrote above. And I'm certain of the fact that this next fallout will have more in common with fallout 1 and 2 then any other fallout this earth will ever see.

Oh and if the conjecture I typed above ends up being true... Then I would wager their would be some sort of clause in the settlement that would delay one of the games so they don't end up fighting each other for sales. If their is no clause...

I think it's safe to say PV13 will be released 9-15 months from now, or at the very least a public beta. That's right around the time it would take to make a new fallout on the creation engine. Skyrim was the guinnea pig on the engine, and it's going to be the third fallout game for bethesda so that means a lot of copy pasting on textures as well as game mechanics.



I get that some people didn't like fallout 3 or new vegas, because you love fallout 1 and 2. I think it's safe to say that if that's the case with some of you, then you're going to love the next fallout because Tim Cain made fallout 1 and 2 what it is.

You have to remember that if Bethesda loses the right to make Fallout games they have one more Fallout game to make, then no Fallout games without a new license. I do not think that result would be likely in open court, but I think it is possible Bethesda might give up the rights just to move on with their lives. If that is the case, which I very much hope it is not, then Obsidian would have to license Fallout from gamesas in order for Tim Cain to have his triumphant return to the series, because I doubt Bethesda would use its last game on something it did not develop itself.

I think you are being very optimistic about when the next Bethesda made Fallout game will come out. We will be waiting until at least 2014 more than likely. It was about 3 years between Fallout 3 and Skyrim. Sure New Vegas came out in the interim, but that was not actually developed by Bethesda. Skyrim would have taken extra time because of the new engine, but still. Good games take time and I would rather wait than be disappointed.

I do not see Bethesda laying down much money on gamesas at this point. They might invest some money, but certainly not $35 million.
