Hey everyone I was wondering if I have the rights to post videos of my mods on YouTube with ads? I see other users have but I was denied by YouTube saying I didn't have proof of ownership. So is there an article somewhere from Bethesda saying we can post mod/game footage on YouTube for promotion/monetizing? So far I have been unable to find anything that would provide information either way. Thanks

Considering Bethesda make use of privately made mods to advertise the versatility of the game and creation kit in order to boost sales, they would be laughed out of court if they tried to ban it the other way. I think Bethesda are far too sensible, far too busy, far too customer oriented to begrudge you a mod maker showcasing your mods on Youtube and gaining advertising revenue for having gone to the trouble to do so.

Besides if I make a video of a walk across some hills and those hills happen to be in private ownership? There is a saying at least in the UK. lex de minimis non curat. (The law doesnt care about insignificant matters).

I would say that if the video contains significant footage of your mod then you're fine. If its ten minutes of game footage with a mod made statue of a mouse in for ten seconds in a small corner, then its not about the mod is it.

The way I see it is that it is the same as Microsoft Word.

Microsoft can't stop people from making money off derivatives from Word.

If you're using tools created by gamesas to create a derivative work then you hold title to that work.

Otherwise Valve wouldn't have put such draconian EULA against modders uploading to their Workshop. It would have been a given that modders have no Rights to their work.

Also...

You should reply to YouTube that your mod is a derivative work and that should appease them.

Oh and I think the issue was YouTube saw it as only game footage which they don't allow. If I add a narration (which I did) it becomes a walkthrough and is therefor an original film. Time will tell if im correct or not but I only see that difference between my video and others.
