He's not a murderer. In fact, the people who contact the Dark Brotherhood are almost never murderers, because why else would they contact them? Even if he was, why the hell would your reaction to a murderer be to murder him?

He may not be innocent of the crime, but he is not guilty of the deed. He's a murderer by law but not by actions.

And honestly, who could blame the kid? If I was all alone and had to live under some woman who was terribly abusive all the time, I'd want her to be dead too. I feel like killing that old woman was one of the most benevolent things I did the entire game.
