You can not use that in combat

So I'm in Kolskeggr mine with a bunch of Forsworn and gold ore veins. Whenever I try to mine them it tells me I'm in combat so I can't....except I'm not. I've already killed EVERYONE in the mine yet it won't let me swing my pickaxe. I've tried leaving the mine and coming back and quitting Skyrim and restarting it, but it still tells me I'm in combat when I'm not. Has anyone seen this before? Sorry if you read this before I editted, I accidentally hit enter before I even wrote this :P

Something might be targeting you that you are unaware of or perhaps an npc got stuck in a wall or something.

Try this -

Equip the pickaxe like a weapon and actually swing at the vein, you should be able to collect the ore that way.

You can also try exiting the mine and getting into combat with some creature elsewhere in the game. Then reenter the mine and try again.

save and reload... Fixes most in-game stuck actions... Like dead NPC's still thinking they are in mid-swing, because they died in mid-swing...

Also works for stuck dialogue, non-attacking creatures, non-hittable creatures, and getting stuck in the landscape...

Yeah nothing was working, I mined the ore by doing what xexus said and just swinging at it like you'd normally fight, but then when I left and tried to use the smelter outside it said the same thing :/ Going into a cave further along the road and getting into a fight there and then going back seems to have fixed it like jWenham suggested though. Which was weird because I got that message for the ore since first going into the mine before I killed all the Foresworn in it.

Solution:

Dont use the default command to mine, u can also mine by selecting the pickaxe as a weapon, than start hitting the ore mines like they are an enemy and voila u are mining the ores. AND YES IT WORKS!!
