So on my latest play through I waited until I was level 50 to start doing my thieves guild quests to get the maxed level gear, well I get the Nightingale sword and Bow and I have a small issue I can upgrade the bow, to Legendary Just like I could on my previous character but the Nightingale Blade doesn't even show up with the option to upgrade it has this happened to anyone else?

Known bug/glitch. You can upgrade lesser versions of the sword (ones obtained at lvl 45 or lower) but not the final 46+ one.

Well that just bites I hope they fix it as right now all I have is a wall hanger

If you're on PC, you can open the console and type in:

player.additem f6526 1

to give yourself the next best version, and upgrade that. It's only a little bit less powerful to start out.

I have it on both, its on the Xbox I have the issue or I would have just gone into the shopping ( coc QA smoke ) room and picked out the other one guess I will be waiting for a fix on that one. Though I have started to mainly playing on the pc anyways since my daughter started playing Skyrim and took over my xbox!
