This problem is happening to pretty much everyone. Sit tight and wait for a patch.

Pickpocket the key to Windhelm's house from an NPC, I forget her name but she appears in the market everyday at 12pm. Get inside the house and find the clues and the quest should be triggered, there's also a woman you need to talk to who is usually in the inn, her name is on one of the clues you'll find.

I think if you buy the house and enter it it will start the quest

So you have to pickpocket Hjerim's key from Tova Shatter-Shield (you can do this at night while she's sleeping at her house (House of Clan Shatter-Shield). Then you visit Hjerim. When you enter, Blood on the Ice quest should activate. Now, you have to follow the quest.

i didn't have to pickpocket anyone to complete this quest without bugs.

the only bug was that they said to go back AT NIGHT. i had stuff to sell right away at midday and had to stop the guy from slitting the girl. i did. quest over.

First time I did this I bought the house and ended up with a non-killable murderer living with me.

Second time (post 1.4) I got the quest to start and finish but never bought the house since I didn't finish the civil war quest yet.

I thought the patch added new dialog that let you ask the guy that sells the upgrades to 'clean the house' or something like that.

I completed the quest no problem after 1.4 I play on Xbox. As far as the blood and bones and such, you need to buy the clean up option from the steward once you own the house. Cost 500 gold.

buying Hjerim will not fix anything. I had bought the house on my previous character and nothing happen. In fact I was quite annoy that the butcher guy was inside my house looking around in my personal stuffs. I tried attacking and i ended up getting a bounty over my head.

I did buy the house just for the sake of seeing whether or not this would reset the house or something. It did not so i searched the internet and found that you have to pay 500 gold to actually get the blood and bones out. its not free! So for 500 gold the house no longer looks like a crime scene.

I was able to get it done on both characters and on one I even did some major no-nos. :o
Spoiler
Supposedly, if you kill Muiri's secondary target in the DB questline the mother commits suicide and that's supposed to break the quest because I believe she's one of the witnesses you're supposed to question, but I was still able to complete the quest. :o I'm just lucky as hell, I guess.

The bones disappear as well as the other rubbish some time after the investigation. The blood stains remain in the living room, however. When speaking to Jorleif about upgrades to Hjerim, be sure to buy the cleanup option before buying the living room package. Otherwise the option is removed.
