Regarding souls being trapped within soul gems, that's exactly what happens. Maiq the liar says so, and in Daggerfall, souls could be released from enchanted items if they broke, at which point the enemy would be very upset with you.

There's also the Redguard Mage in oblivion that refers to using soul gems being unethical, though that doesn't directly point to consciousness being imprisoned.
