Im confused.. so you CANT use the nexus to upload mods anymo

Once the Steam ws comes out, is the only legal/technically possible way to upload mods?

No. By default the Construction Kit won't upload to Steam. It will only upload to Steam if you specifically tell it to =P

Of course, you’ll still be able to use popular fan-hosted mod sites like Skyrim Nexus to find great mods to play. We did not change any functionality to exclude the way mods worked previously. We even added a few features to help out — for instance, custom INI files can now be packaged into mods so you don’t need to backup your INI files anymore.

Wow is this question continuing to surface because conspiracy theorists have stirred the pot or is there really something insidious about the messages from Bethesda?

I think the former - bored forum users who just had to look for how it was going to be bad and then stacked ten threads on top of this fear to call it a theory.
