Does this qualify as a NPC respawn as supposedly patched in

Hey all,

Please have some patience as I'm a forum newbie and may be duplicating an already discussed topic!

Anyways, here's my issue: I've been waiting for the 1.6 patch to come along in the hopes of the NPC respawn issue being corrected. Specifically, the only larger quest line I have left to complete is the Companions one, which I started some time ago but got stuck upon being given my first job, which was to intimidate Marcurio outside of Riften. Problem being, I had killed the guy many moons before getting this quest, and no matter how much I asked him he continued to stay clean of the nasty oxygen habit he had previously (i.e., stayed dead and did not respawn).

Along comes update 1.6 and the fix for my problem! Only problem is that a month plus of gametime has gone by and he remains dead. Oh and I should point out also that despite being instructed to intimidate him outside Riften, he is lying dead in the dungeon I found him in which is quite a distance from Riften.

So, a few questions I have:

1) Is this one of those situations where the NPC should have respawned?
2) If yes, have I waited long enough post-update 1.6 for him to have respawned?
3) If he is not going to respawn, how do I get around this?
4) Why now when I walk into Jorrvaskr does Farkas keep drawing his sword on me and entering into dialogue when I haven't requested it? When I back out of it, it re-engages 3-4 seconds later.

Any guidance or clarification around this would be appreciated. I'm assuming this is an ongoing software issue so have tried to place the post appropriately.

Named NPC's do not respawn, so the 1.6 respawn bug fix would not work. An example of what the patch fixed was the giants and mammoths not respawning.
I have had a problem like this, but with Aela's jobs to kill animals. I had to kill a bear that was already dead.
The only fix I can think of is to reload an old save, but it looks like that's not an option for you.

The issue is known, but there is no way to fix this on consoles, only on PC as shown on the UESP http://www.uesp.net/wiki/Skyrim:Hired_Muscle in the bugs section (link is just for reference).
The only chance you have of continuing the Companions quest line is if this gets patched in the future.
