I only married him because I wanted his estate/riches since he owns the blacksmith shop in Markarth. Can I keep his shop after he's been murdered?

Anyway, yeah just sneak and kill him in his sleep. Make sure there aren't any witnesses. Or have him follow you into the wilderness and leave him to "defend" you from a dragon attack. And die in the process, so technically your hands are clean.
