I have started out clean fresh without any mods and im still standing on my horse >.> if there is anything someone can help me fix this id most appreciate it its fustrating the hell out of me

Please say what you mean by "fresh". Did you completely delete the left over files in the Skyrim directory after uninstalling as well as wiping the INI files in the (My )Documents/(My )Games/Skyrim directory?

Verify your cache to generate new .ini files.

Also, unchecking your mods might not be enough to actually disable them. Check your Skyrim > Data > Meshes > Actors > Character folder for anything that might mess with proper seating on horses.
