im at the part of the quest when the black briar lady knows that I am stealing the horse.

Right next to the ladder into the basemant is a strongbox containing 250 gold on top of a crate. The strongbox is master level but can be opened using http://www.uesp.net/wiki/Skyrim:Sibbi%27s_Stash_Key if you got it. Around the corner, you will find the lineage papers on a table.

The "basemant" referred to is the basemant of Black-Briar Lodge, which is where you have to go to get both the horse and the papers.
