If they write software that is too demanding for the current hardware, you bet your ass it's a programming problem. Obviously they should stay within the limit of what's actually playable without freezing, that goes without saying.
However, I find that idea very unlikely anyway, FO3 and NV can't be the most demanding game out there. A game like Just Cause 2 has better graphics and works flawlessly.
(And how much resources a game uses actually depends largely on programming too, badly written code uses more resources while doing the exact same thing. To write efficient code is a skill. It's possible to write a tic-tac-toe with C64 graphics that still uses more resources than Fallout 3, just throw in a lot of crazy loops in the mix.)
