Well the release is really soon so its highly likely that retail stores already have it in stock, and sometimes some stupid employee puts them on the shelf accidentally and someone buys it.

EDIT:
Its no biggie though since the game uses Steamworks. Even if you get the game early you cannot play it untill Steam unlocks it.

Well I'm sure someone will get the console version early and start posting playthroughs/streams etc, it happens, what can you do.
But for the PC version, because it uses Steamworks, nobody will be able to play it untill Steam unlocks it.

When Skyrim was close to release, I visited every store in town that sold video games, trying to find one that had mistakenly put it out. No luck, but the thrill of it was very exciting.

I'm in a new town now, so the hunt will be even more fun, though I don't expect to find one.
