False Advertising = Fraud!

Post » Thu Dec 03, 2015 3:50 am

After buying fallout 4 pip boy edition for ps4 and steam standard edition, I am extremely disappointed. No where on the steam page does it list the game runs with nividia gameworks. This is disingenuous and quite frankly close to fraud.

Being an AMD user I would never buy a game that supports software that cannot be run or utilized by AMD. It's sole purpose is to affect how well my card performs. If your store page had listed gameworks prior to me ordering it I would never have pre ordered.

I feel Bethesda as a company is responsible for not detailing this issue. I will be returning both versions and will no longer support or buy any Bethesdas games. This is nothing more than a complete farce.

It was announced ~2 weeks before its release.

Funny that as it's not stated on the store page. You know where details should be listed. It is not my job to follow all announcements by Bethesda. If it is not on store page it is false advertising no if's or buts about it.

False advertising assumes that the party doing the advertising knowingly lied about something. Your own prejudices against Nvidia does not constitute false advertising.

Have AMD system, completely, game runs like a charm at Ultra settings and super high resolution, sans the UI not scaling correctly for said resolution. (5760x1080) but that's another topic all together.

They knowingly withheld information that has a negative impact on users with specific hardware. That constitutes false advertising.

Using a Radeon R9 270x myself, I must tell the original poster that he makes false allegations. So is this posting fraud now? Should he taken responsible?

Except the game runs fine with AMD hardware. It's just a few graphics options you can't enable. Nothing new there. Plenty of games have had additional options for those with Nvidia GPU's (and even some the other way around). In the end it doesn't deliberately make the game run poorly on AMD hardware, it's just icing on the cake for Nvidia hardware. It's nowhere near false advertising.

Every professional benchmark website agrees with me. Gameworks harms AMD performance. That a r9 390x is sitting at 40fps while a gtx 970 is hitting 60fps is nothing but a complete joke. However this is not about how the game performs. It is the fact it is not listed on the store page as being a Gameworks game, this is false advertising period. Will be filing a petition with trading standards over this incident.

Gameworks is for Nvidia. Don't enable it. They didn't withhold it, they announced it. So probably the store's fault.

I found all the posts in this thread to be fraudulent

because your profiles don't specify what you were about to say.

:brokencomputer:

I will withdraw my support from this thread as it is (genuinely) a complete farce !

Again it has been withheld because the information is not available in store. Please stop with the excuses, this is blatant fraud.

The Consumer Protection from Unfair Trading Regulations mean you can’t mislead or harass consumers by, for example:

leaving out important information.

Can you still play the game? Yes. So no false advertising. False advertising would be if Bethesda said the game runs on AMD cards and then it won't run at all. So no case. So play the game and have fun.

the game runs on AMDs

the thing is that they optimised it for Nvidia. this basically just means that you can run it better on older Nvidia sets

Kind of like how some older games are optimized to run "better" on Intel chips.

nothing really new to see here.

I am "chill", just disappointed and frustrated that this was not advertised on the store page. I respected and was pretty much a long term fan of Bethesda. Heck I grew up playing daggerfall and still do boot it up to this day when I feel nostalgic.

I guess for Bethesda money really is green.

No different from the earlier "The way it's meant to be played" or even AMD's equivalent thingie. It just says it might run better on one or the other, and on some cases has run better on the opposite hardware than the advertised.

In the long run it means absolutely nothing. There's no false advertisemant here, only false allegations of false advertisemant.

I understand the technical point the OP is trying to make.

But to my mind it is pedantry where the highest legal redress possible is a refund.

In an complex game, there are a host of things that may or may not be in the pack description.

As long as it 'just works' the consumer is not arbiter of how it is achieved.

Isn't this only like during the XP into Vista era when some games started have extra graphics features for DX10 and DX11?

Xp users couldn't make use of those either. Did we rise up with cries of false advertising because they DIDN'T advertise that fact?

No, we didn't.

Yep, I run all AMD and it's purring like a kitten for me. Like Clapton said, it's in the way that you use it.
