The fault is on Microsolft. They have to make sure the products they make and they sell for a fortune last long.

Its the consumer who bears the burden of proof as they are bringing the action
However since its a civil matter rather than criminal the standard of proof required is lower, on the balance of probability rather than beyond reasonable doubt

The 360 came with RRoD and other problems like the DVD drive going out and crap. That console was a consumer risk in the early years, but they designed better since then.

Never put the PS4 on its side while playing, I'm currently stuck in the Arkham Knight Universe and Hell is a much better place than this. My limited knowledge of the Batman universe is somewhat helpful but I could really go for my .44 Mag at my side right about now.

Anyway I'm kinda half N half on the lawsuit here. On one side the consumer could have bought a faulty unit and Microsoft is guilty of putting out new consoles which have known to have defects. On the other hand the consumer could have damage the product on his own in which case it's his fault. Reasons like this I keep my system flat, to avoid scratching the disk and avoid opening portals to alternate dimensions

If you move it around while it's running then that's your fault. I never understood why people like to stand the console on it's side...you're just asking for trouble.
I think I was told by a MS personal one time the reason for placing the unit on its side was for venting purposes, but I've always uses the packing styrofoam or cardboard box to lift the unit and give it an even better ventilation, heck I'm doing it to my PS4 as we speak---er type

My sentiment on the matter as well. It just seems like common sense to not move anything while its turned on.

Funny, I have the opposite change. In my early lifetime, we probably went through 8 different PS2s... And my personal original Xbox, and first Xbox 360 are still alive and kicking after so many years of us. Yes, my Xbox 360's disc tray doesn't work when it's empty and my 360's disc reader lags in the cold but otherwise. My 360 works very well still and plays just fine.
