As far as I understand when we die, we have two choices:

1. Ress at nearest Wayshrine

2. Ress here ( requires soul gem )

Let`s tell I die in battle fighting my enemy, I have 10 soul gems, will I be able ress as soon as he kills me in place? Even with cooldown it would be akward for me to kill someone and he can ress in place right away even in 10 seconds it would be stupid.

Those penalties are for pve. A previous article (can't find it right now) gave us the useful nugget that you can only rez in Cyrodiil at an uncontested keep. So no, that guy you just squished won't be jumping right back up.
