xbox unable to read disk

Tonight I put my Skyrim disk in for a little time in Skyrim and found my xbox is reporting that my disk is not recognized. I have tried to clean with a soft cloth and waterit but no luck. I have tried disks for other games and they seem to work fine. I took another look and I see what looks like liquid spot on the disk. I have tried to clean it and get the spot to come off but it will not come off. I have used a DVD cleaner that I have used to fix DVDs with minor scratches but that has not fix the problem.

Is it possible to get a replacement disk from Bethesa? If so what is the process for doing that. If I have to buy a new disk will I be able to play my saved game. I would really hate to have to start over!

I should also point out that before trying to play I installed a new 120GB hard drive. Prior to that I had no hard drive. I transferred all of my saved games from the system memory to the had drive and then tried the Skyrim that is when I notice when the unrecognized disk error I am getting reads:

Unrecognized Disk
This disc is unreadable

Status code: 03-57-00

Is this a DRM issue because I moved everything from system memory to the HD or is the problem due to the spot on the disc and I need a new one?
