and its all fine but if I use paralyse on a guard the punishment = death with out the option to surrender ...

Insta-kills from the shadows means no-one is aware you did it. Paralyze means the gaurd is aware it was you because he aint dead and therefor you get caught.

but why can i walk up to guard say hi then pull out thunder bolt charge it up aim at his face and cast it , leaving him with like 10 -20 health then walk away like nothing happend .-.

Edit: also doing this with out being in sneak mode)
