Developers don't decide what a game is rated, the ESRB, PEGI, and other such places do. The only impact Treyarch (or any developer for that matter) can have on a game's rating is how much gore/language/etc. they decide to put into the game.
As for Brink's rating, my interest in the game wasn't sparked by how much my enemies would bleed or the amount of profanity I would hear, so I honestly couldn't care less. I care about gameplay, not rating.
