So weird, I have come across this guy 3 times the last two times I have had to kill him because I didn't want to "Pay up". Does he ever die or should I say, stay dead?

There is talk of this in the Unofficial Skyrim Patch thread. The recent comments mention the quest for this is set to repeat. And that seems to be what many people are questioning. Seems like it should only happen once. Kivan might be able to fix it in the next USKP or maybe Bethesda will in patch 1.6

I've come across him twice and didn't want to pay him either time. Old Deep-in-his-cups will remain empty-in-his-pockets when he comes across me. :)

i'm definitely excited to replay oblivion to compare it directly to skyrim and revisit the greatness of the isles.

You won't until you complete the prerequisite quest, which is only given by one NPC who appears in one particular location (altho I have known him to follow me home if I take a pass on it too many times). IIRC it's also unavailable until you reach a certain level.

I know petitions are against the forum rules and everything, but I'd so petition to have "Deep-in-his-cups" as a companion after "A night to remember" assuming you pay the 10,000 Gold or succeed in non intimidation persuasion.

I never heard of him x) What is he? a NPC that you can find in skyrim i guess? where? argonian?

NPC spawned after you complete "A Night to Remember". He's limited to radiant encounters, so if you fast travel a lot, you'll probably never see him.

He's an NPC who will be looking for you after you complete the quest that is the prerequisite for his appearance. Basically you accept a quest from another NPC, hilarity ensues, after that quest is over Deep In His Cups will just randomly find you at some point. He will claim that you owe him money as a result of things that may or may not have happened during the course of the previous quest. I don't know how much more can be said without spoiling anything and I haven't figured out how spoiler tags work, lol.
