if you're on the PC use the bring up the console (the "~" key) click on your spouse type "kill" and press enter. Try that.

Unkillable? Who'd you marry. All the followers can be killed... you simply need to wait until they've been hurt enough and drop to their knees. At that point, enemies will ignore them, but they can be killed with a single hit.

I don't believe there's a mechanic built into the game for re-marriage though if that's what you're after.
