Is it possible to have a faction be the owner of something (in my case a horse) and when I go to activate that object it not be registered as stealing?

I created a new faction and added the player in as the only entity then assigned the owner of the horse to the new faction. Thing is when I look at the horse it says "steal". I was under the impression that being in the faction allowed you to take their stuff without it being a crime.

OK sorry managed to sort it, for some reason although the player was a member in the CK it was not a member in the particular save game I was using to test with. Probably just need to start a new game.
