Hey something that I've never seen before just happen.
I was walking on my travels from whiterun to valtheim towers and I got ambushed by a bandit group.

Here's how it went:

4 bandits ambushed me and I run back to get some distance from the archers and to use my own bow. Anyway I deal with the two bandits rushing me, then move to take one of the archers. After I killed him and I can still see this red dot on my compass so I went to investigate. I find the other archer cowering behind a rock and he screamed "death is overrated" he then jumps up and runs away. Curious to see what happens I followed him to see if he would attack me and he didn't he just ran and ran so I stabbed him in the back.

So the question is have they fixed this and what experiences have you been across where this has happened?

He was running, and that was not surrendering?

I think the OP is falsely assuming when the enemy surrenderes its genuine.
