Is starting the game considered "gaining your first leve

I'm wondering this specifically for the purposes of SM Event Nodes. I have a quest running that gives a perk point (by setting a global to increment by 1) every time the player levels. Thing is, when I CTEST in and talk to her, she is already acting as if she has a perk point. I don't know why...
EDIT: Nvm, she is acting like the has all the perk points in the world. Now I'm really confused, also she's behaving as if the conditions of my dialogue don't even matter. I have perk trees arranged as dialogue trees, and rather than the perks having conditions, the dialogue options do. Thing is, she's just blatantly ignoring all the conditions. Back to the drawing board in a few days, I think I need a break from modding.

I had a though as to why this might be occurring. In the quest that handles the dialogue I'm talking about, I for the first time used "Dialogue Conditions" under the quest data tab. Are there known problems with this? Also, do they work the same way other dialogue conditions, and this basically just says "Every dialogue topic in this quest can only be said if these conditions are satisfied"? Or does it mean something else?

One other thing, if I am using a GetGlobalValue condition, does it matter what I run it on? I've been running on subject or target interchangeably, because its a global value after all. Maybe this is what si screwing me up?
