This problem, even with the updated patch still do exist. I feel sorry for the console players having to deal with this problem because theirs basically nothing that they can do. I heard killing off of the guards can help.... but for some reason they never respawn so you're left with a city guard-less.

The only thing that you can do is to use the paycrimegold code on ~

The way I was able to fix it on my 360 without using the console was by running to the Shrine of Talos in Markarth, avoiding dialogue with all guards even as they chased me down, then once you get to the shrine and they do their talking bit, murder every guard that comes through the door. Unlike the open city, they'll eventually stop spawning. When that happens, go back outside to Markarth, pay the fine, you should be good.

I thought that the glitch was caused by resisting arrest in The Temple of Talos instead of just going right to the mine when the guards confront you. If you just get arrested right away and don't fight any of the guards arresting you in the Temple of Talos, the glitch shouldn't occur.

That is indeed the case. And after the quest finishes and escape Cidhna Mine, if you ever accumulate a bounty in The Reach all the guards run at you and give you the quest-related arrest dialogue, so you can't pay it off or anything. The fix I mentioned worked for me in I thiiiiiink 1.3 but I'm not 100%. I'd sure hope it still works in 1.4 but yeah, it's best to just go quietly with the guards. x.x

What glitch? Do the crime, do the time. Whatever. Strangely, however screwed up my toons have been, they always got through this quest one way or another. I think this is what they (Beth!) intended. It's just that they didn't anticipate all the crazy ways people would arrive at a particular quest juncture.

I've got an idea... maybe some quests, once acquired, should be pursued with great alacrity, rather than tossing them aside for later investigation. Maybe that's where the cookie crumbles and quests get buggy. We put them off long enough for so many possible influences to start to confuse matters.

It's because you helped the forsworn in the mine. You were given two clear (to me at least) options in the mine: kill madanach or help him escape. I killed him and never had an issue, whereas I'm assuming you helped him and now your finding yourself in this dilemma.

Yes, it's the players' fault. Wonderful.

I have an idea, what about the smith in Markarth that you can't invest in? Will they fix her?
What about the permanent/hostile/invincible Unbound Dremora I have living in Winterhold?
What about all the other busted crapola?

The glitch is that the guards still try to arrest you after you escape Cidhna Mine and complete the quest if you resist arrest in The Temple of Talos, no matter what you do. The only way to fix i is to use the console command "paycrimegold" with a Markarth guard selected.

On my last toon (Before I was forced to retire him due to glitches after glitches) Had this problem after completing the quest some time ago
http://www.youtube.com/watch?v=2BmI9VbKbf4 and when I try to submit the guard didn't send me to jail. It keeps giving me the dialogue " What is the problem?" and it keeps going and going until you disable it. For me the guard doesn't attack me but to walk away as if nothing had happen.
