unable to download new patch

I downloaded the complete NV game from Xbox Live via Games On Demand, and only the 1.2 patch downloads, not the 1.3

I cleared system cache and redownloaded the patch- it is only the 1.2 patch.

I am having same problem. As of yet i have not heard an official response
