I really dont think you should take what the court notes says to serriously.
It is in gamesass intrest to focus on the parts of the games that are comparable to existing games, when it comes to the trial.
One of the questions to answer is "is it in full development" and then to put out there all the new experimental features is just simply no good. If the game was a total sandbox, they might even be shot down in court due to the grey areas in this field and theire view of "what a game should be" I doubt that grey haired people can bend theire heads around the awesomeness of a true sandbox game.
So gamesas is not forcing them to, they are simply focusing on the parts that are comparable to the existing generic MMO's making them able to say, "this is a generic mmo, and our game at this stage looks allot like it". which in the end is the proof that they are in "full development"
"The good stuff" would just confuse the court, which would be bad.
