Let's say we use the normal attributes, how do you then balance their usefulness. Except for the fact that certain skills are assigned to certain attributes, what else?
Fitness - determines your hp
Agility - ?
Wits - determines how many skills you can choose at the beginning?
Nerve - how many times you can attack during a round?
Code - different rules, as i described before

What would the name be of the players in such a world? They are subbosed to be kind of like wild-western samurai, but with a code based on freedom and not on honor.

Fitness - Stamina(how long you can sprint for or swing power attacks), and endurance (how many hits you can take)
Agility - Speed of drawing weapons, sneaking, run speed and jump height
Wits - Number of Skills, *
Nerve - How many attacks, *
Code - different rules, as i described before
Sorry but is it turn based your making it ?
Wouldn't Nerve and Wits be the same ?

How about duelling? (as in, shooting someone in a duel)
Attribute? That's more like a skill-specific benefit. imo.
And a bad one at that! :D

Wits would be more like intelligence and cunning and nerve more like willpower. How I imagine it: there would be turns and rounds. At the beginning of the turn each player throws as many dice as he has nerve. So lets say it's three and you throw 1,2,6. The second player has four nerve and he throws out: 2,2,3,4. The turn has six rounds. In the 1st round the first player attacks, in the second both (the one with higher agility first), in the 3rd round the second player, in the 4th the second one, in the 5th none and in the sixth the first one.

And many of the things you wrote would be just determined by skills and not attributes. So this is how I see it now:
Strength - amount of life
Agility - who attaks first
Wits - amount of skills? this I'd rather change
Nerve - amount of rounds

Strength - sounds good, would this also determinate your physical attacks?
Agility - Agility would be better if it was renamed as "Reflexes".
Wits - Amount of skill points during character creation, or in total?
Nerve - So if I understood it correctly. Nerve attribute is your "Action points". I would make action points standard, because currently it is the attribute you need to have maxed out in order to be a badass.

Yah, it is kind of a badass attribute. You asked about the physical attacks, well all abilities would be added to skills too. So you'd add strength to meele, agility to perception and so on. Now I'm thinking that I could add charm or charisma. So in this case nerve wouldn't really determine any skills, but would be action points. But then what could charisma do escept for supporting skills?

Charisma is almost always linked to support skills. I've used it with spell casting in my own rule set. If you have party skills such as leadership or something similar. Charisma can be powerful attribute to play with if such skills. Example in my rule set, Leadership skill roll can determinate initiative roll for entire party. And this leads to situations where whole lot of people are acting before enemy.

Oh, and what is your setting?

Currently the main emphasis of the game is on feudal japan themed nation and its surroundings.

So now I'm working on another aspect of my western rpg - magic. I want to create a couple of types of magic that would fit the setting and I inspired myself by the elder scrolls game to balance it out and create a type of magic for every elder scrolls school.
Alteration - shapeshifting, indian type shamanistic rituals that can change you into different animals
Destruction - steelmagic, magic of metal, you can make bullets faster, bend traintracks and craft magical pistols
Restoration - healing, stylized for mexican or louisiana, strange - witch doctor magic
Illusion - illusion  kind of like more traditional or xix century magic, from making stuff dissapear to mind control
Conjuration/mysticism - spirit summoing, befriending a spirit and being able summon and control it.

So what do you think of these ideas?
