Well, Constance says the same. But a few added lines of dialogue should fix that either way.
GRELOD ALIVE:
DRAGONBORN: "I would like to adopt one of the children."
GRELOD: "And why should I let you adopt one of these useless little pig droppings?"
DRAGONBORN:
Persuade: "You obviously can't stand them. Why don't you let me take one off your hands?"
Bribe: "How about an 'adoption fee' of 100 septims?"
Intimidate: "I'll bet Constance would allow it... once you're out of the way."
Status: "Why don't I talk to the jarl? I'm Thane of the Rift, so I think she'd listen to me."
GRELOD: "Fine, whatever. I don't care. Talk to Constance."
GRELOD DEAD
DRAGONBORN: "I'd like to adopt one of the children."
CONSTANCE: "I see... and after what you did to Grelod, why should I trust you with one of my children?"
DRAGONBORN:
Persuade: "Grelod was an evil hag who abused the children. She had to be dealt with."
Status: "Since I'm Thane of the Rift, I'm certain that the jarl will vouch for me."
Either way, you would simply arrange the adoption with Constance. Then, go to the child you've chosen and offer to adopt him/her. Easy as pie.
