Strictly speaking, yes, they CAN do this because the EULA for the CS and GECK allows them to.

EULAs aren't everything. If a mod was made just using the Construction Set, then Bethesda might be able to make an argument (probably not though). If the modder has created things outside the construction set (textures/models/etc) then Bethesda wouldn't have a leg to stand on legally. The fact is that mods contain the creative work of the modder, and no EULA can give Bethesda complete rights over that.

In this case, yes, the EULA is everything because it covers them for anything generated via the CS. Disagree and challenge them on it and Zenimax's lawyers will bury you. Simple as that.

It only falls short if the meshes/textures/audio/sound that's created is entirely original. Derived works would be theirs by default already.

could be free if Bethesda wanted it to be ,but if the mod was really worth it i would pay a reasonable amount say $3-7 or $10 depending on the actual amount of content in the mod set as dlc for consoles

This is why the current generation of consoles has crapped up gaming.

Chances are they won't though because it has to go through Microsoft certification and user generated content is unlikely to get past that. Plus, it would surely anger the community if this happened and I doubt even Bethesda wants to deal with that kind of negative publicity.

As long as Bethesda were to pay them for it like Valve does with community made TF2 stuff, I don't see why anyone would get angry unless they were just jealous.

would it anger the community if bethesda was to buy the mod from the creator, edit thier own way and then put it through microsoft certification as thier own product, and with every download the mod creator get a cut

As with any developer/modding community relationship over all genre's ...idea's, concepts and mods have been taken and implemented into the games.the only thing missing was the paid aspect.

Would it anger the community ? Heaven's No...the modding communities have been serially expunged from gaming by greedy publishers over several years.

Besides..No payment will ever arise for someone else's creation.It's their IP, their tools and anything you create using their software comes under their ownership....read the EULA

This is not going to happen for the moment, maybe at sometime in the future user made mods will be available for console users - who knows?

I am closing this before the discussion turns to breaking ToS and EULAs.
