Bethesda: Maluka, the girl who did the amazing ‘Dragonborn C

Maluka, the girl who did the amazing ‘The Dragonborne Comes’ cover as seen below has a company calling themselves ‘Symbolic Digital Movies’ trying to claim ownership of her ‘The Dragonborn Comes’ cover/video.

They are a copyright troll company who claims ownership of any video which receives a lot of hits in the hopes that the person who owns the video doesn’t know how to fight back and so that they can put up ads on said video and turn a profit.

I really think that Bethesda ought to do this girl a solid and smack this criminal scum down Fus Ro Da style on behalf of her, fans everywhere and to defend their own intellectual property.

the Sheer number of people who've seen her vids thus far, and the likes is enough support that they can't pull such bs(can they?), BUT BUT BUT This is and AWESOME CHANCE for Zenimax's Attorney Legion to sharpen their claws on something worthwhile.

The title of the post really should have read 'copyright trolls' rather than 'patent trolls'. I didn't realize my mistake until after submitting the post and the edit function doesn't seem to allow editing of a posts title.

My endorsemant and support to Maluka. I hope Bethesda (which they even published her video in their blog, so they just CAN'T be related to that) gives that bunch what they deserve.

On what grounds can they claim anything? Figured only Bethesda would be able to that and they have no motive to do so.

Could they cause harm if she chose to ignore them?

That's impossible.

As long as you give credit to the original artist, you can cover ANY song you wish, and she has not made any money off it, and therefore doesn't have to pay any royalties. If any company tries to own her music she can take them to court, and she will win even with the worst lawyer in the world. She said that the song belongs to Jeremy Soule and Bethesda, so she's set. She would only be brought to court if she took the credit for writing the song and released it for profit, then she can be taken to court (think Led Zeppelin)

Plus...it's just youtube....think about that ugly deformed girl that only sings other people's songs and has celebrities come on. She monopolized that and made money off it, and yet nobody tried to own her videos. Maluka on the other hand just recorded a cover without any profit, just for the sake of fun and sharing it with others (I think).



In other words, quit exaggerating, she doesn't need any help.

You can never be too sure, and even less in this world...and even less with the laws of this world.

Still, I'm glad to hear they're only a bunch of losers that have to scrap their miseries for a living, and that she's safe.

Worst case scenario, they muscle youtube with empty threats to have them take down the videos, or put that tag that says "this video uses copyrighted material" and mutes them.

But that's near-impossible because she performed the song herself and gave credit to the original artist. As long as you do that, you can cover anything you want and get away with it. So she owns the music to that (but of course, only the music she performed, not the music in the game)

You need to go do some research before making a post like this. It can, and does happen. The status of copyright and patent law is unfortunately very messed up and there are many corporations which make vast amounts of money purely off of actions like this. Symbolic Digital Movies is one of he notorious ones. I'm not sure what the extent of what they can get away with is, but at very least they need to be prevented from taking credit from and/or making a dime off of Maluka, Jeremy Soule and Behesda's work. The good thing is that hopefuly a counter suit on the part of Bethesda and/or Maluka will end this.

It all depends on how many copies you make (Maluka created 0 copies and did not make her music available for digital copies, only way to download it is by ripping it off the youtube video). There is a formula I think for licensing and royalty fees. But since she made no money and sold no copies, she owes no money

All that she has to do is click the button. "I agree that this is an original production that I have the rights to publish.", and simply add to the submission, "This is a (Fair use) reproduction of credited works of art. Credit was given to the original creators."

Youtube simply has that "check" in place, to remove "Questionable" material. Those who simply agree with the extended "right to publish", unlocks the video until some form of actual legal take-down notice is delivered from a lawyer with actual legal "proof of ownership".

I had a video which had recorded copyright music... the music was playing on a radio, in the public, and thus, fell under "fair use" of copyrighted material. Same goes for any personal rendition of a song. Only the owner themselves, can issue a take-down notice. Through the hand of a lawyer, with proof of ownership.
