Grounds to return?

I've had countless problems with the game on my fat ps3 (note.. never had a single problem with resonance of fate). It has frozen about 4 times already and has countless jitters not to mention all the visual bugs. After hard rebooting one time after it froze I tried to start the game again and got the blue screen error (NEVER HAD IT BEFORE). I turned off my system and turned it back on. Even on startup it still had the blue screen error. Thankfully my system wasn't bricked all I had to do was reset my display setting by performing a hardware display reboot (when the system is off hold the power button through it's paces and turns off again). I really want to play the game but I don't want to risk it bricking my SYSTEM. My point is if I bought a tv that had this many problems I'd be able to return it because it is faulty. I've played many games that have had problems but never a console game with this many game breaking problems before. I know they "plan" to release a patch, but I don't remember agreeing that the game may need a patch to be playable. When you buy a online game it comes with the general understanding that there may be problems that will be patched. Single player console games from my experience never have needed patches to become playable. Of course they'll patch once in awhile to fix minor bugs but never to fix things like this.

I've been thinking of returning the game to EB and see if they'll accept it on the grounds it is faulty. The game is not performing the task in which it was sold to perform and is posing a risk to my hardware. I doubt I'll be able to return it, but what do you all think? Anybody else think this is strange for a console game to work this poorly?

Here is a list of the problems I've encountered.

- Unresponsive : Pressing fire and nothing is happening. This will go on for a 5-15 seconds of pressing fire and then it will finally react to the button. This can also be seen when switching weapons. This seems to happen a lot when a few creatures are on screen chasing you (was being chased by 4 rad scorps).

-Visual bug : Everyone has seem them. You'll see creatures sticking halfway out of the ground (watch game trailers review for example). Seen textures of walls flicker.

-Freezing : Game just stops. Cannot even access the controller system menu to quit game because it freezes the whole system. Can cause blue screen error. I fixed by rebooting my display settings (read above).

-Funky logic: When creatures are too close even if you have your gun against their head you'll miss in V.A.T.S. When I say too close I mean directly next to you. I could have a 95% chance to hit with my gun against their head and still miss 3 times in a row.

While I totally feel your pain, unfortunately there isn't a whole lot you can do for returns. The general consensus is, once you've bought a new game and opened it, it cannot be returned for anything but another copy of that game, period. Until the places that sell video games start realizing and embracing how often game developers can fail, they won't ever be held that accountable for their shortcomings. I agree, it's complete [censored] as video games are the ONLY area this really takes effect. Don't believe me? Tell a movie manager that his movie was garbage because halfway through the reel cut out and they had to "patch it" and you won't be coming back to his establishment, BET you'll get a full refund, even though you still saw the movie. Return with a half-eaten sandwich to your favorite fast food place telling them it's wrong, if you tell them you now want a different sandwich, or your money back, they will bend to satisfy, not say, sorry, even though we screwed up and made you go through the inconvenience here, you must get the same sandwich, clearly it was a problem with your mouth, not our sandwich.

So, your best bet is really to keep taking the disc back to the store until you get one that works properly, generally, if others are playing fine and some are having the same set of problems, it can be fixed by getting a completely new disc, and it at least puts the store and the software company out a little by not making more profit off of the stock you go through until you get a good one. (so long as they don't just resell the one you return to the next unsuspecting person)

The man speaks the truth. You might be able to return it if you have a sympathetic gamestop/eb games near you. There is someone over in the 360 bug forum who said he was able to return it for store credit but I don't know how believable that is. I got the game for the 360 and all my saves are corrupt because of a bug...I'm half tempted to try it myself.

the store u got the game from is not accountable. Dont shoot the messager but the person who sent the message. I think your best bet for a full refund would be to contact the developers (somehow) and tell them you are fed up and want your money back. You will probably have to send it to them at your expense. If you have problem with your playstation you have to send it to sony.. u cant simply walk into best buy for a refund.. so i think its the same concept here. good luck.

While I understand EB had no clue they were selling a broken product it still doesn't change the fact they sold me a broken product. I have no disillusions of being able to return it I just find it screwed up. Best buy doesn't test every TV they get in stock and if I went home and it had these kinds of problems I'd be able to return it because it was faulty. If it was determined by them that the product was faulty by design then I assume they would handle it with their provider. Ok maybe another example. If a drug dealer sold sugar instead of coke you'd go back to the drug dealer. Even if he got ripped off by receiving a shipment of sugar and couldn't tell the difference you'd still want your money back from him- not the place he got his "drugs" from.

On a positive note, "Resitance of Fate" is a solid game. The story is a bit hard to pick up, and the combat is complicated, but if you invest the time you'll find a game that gives just as much back.

This game was published by Sega, a company that properly tests their products, such as the title "Valkyria Chronicles", a fantasticly beautiful strategy role-playing game set in a watercolor enviroment and accented with a deep and flowing plot. It's characters are as charasmatic as they are detailed. Yes, this is indeed a smooth playing title that will happily carry you along.

And as far as the company that distributes the product has to go, is to replace a faulty one with a hopefully working one. This is basically to prevent people from being able to buy a game and return it simply because they don't like it. But more and more the case becomes you deal with a game working improperly, even with multiple copies and can't return it to show your disdain for that developer, as you can do with any other product.

If you go and buy a camera from best buy, and it is a piece of garbage, you can go back to best buy and purchase any other camera you want, provided you're in compliance with their return policy, you will pay the difference if there is one, but you won't get told, "sorry, you bought this camera, it's not our fault. They have a return policy on things like this that in turn reflect how they will push items, if they get a ton of one type of camera returned for being defective, you can bet they won't be throwing that camera out on shelves to sell until they know it's been fixed. This isn't the case with video games.

If you try to return a game simply because it's buggy, all you're going to get is a replacement copy. Unless someone comes along that is willing to bend the rules, this is why Wal-Mart still remains a great place to buy games, with a 100% satisfaction guarantee posted everywhere, all you have to do is prove that you've returned a game multiple times, and you are not satisfied with it as a product because it doesn't work, you'll almost always get store credit for something else. I've only done this once, with Mercs 2, but have had friends report that it worked for them as well. I still buy all my new games from Wal-mart.

I must know everything because I said you were missing the point. I was merely pointing out you were missing the point about my drug comparison. It wasn't about how actual drugs. It was a simple second comparison to show where blame resides. It has nothing to do with drugs or to think of game distribution as dealers selling drugs. It shows who is at fault for a faulty product. To show my point which I believe you missed because I used a drug comparison I'll make it a bare bones example.

A = Game Stop
B = Bethesda
U = you, or the person buying the game.
X = Fallout: New Vegas

A sells U a copy of X.
U find out X has faulty design (Freezes your system because of bad programming. )
U deem X to be unplayable or dangerous to your hardware and wish to return it to A
Now since A sold you X to it is reasonable to believe they'd take back X since they sold it to U.
It is not the responsibility of U to return X to B because A sold U a faulty X.
It should be the responsibility of A to return X to B because they sold A a faulty product which was then sold to U.

Ok this has become quite convoluted. Simply saying if game stop sells you a game that freezes 7 times out of 10 they should refund it and send it back to the company they got it from. It is not the responsibility of the customer to contact the distributor of the game because the game doesn't work. It falls to game stop because they sold a game that doesn't work. Only another example will work. If I make a cake and sell it to a bakery. Then they sell it to you and it turns out to have glass it in you'll sue the bakery which in turn will sue me.

A > B > C, C < B < A

! A > B > C, C < A

Did you get my point? I think I might have lost it myself. Is the patch done yet?

Well, they're protecting their own asses. If you can't return it, then the designer cannot take the blame for making a [censored] game such as this. When you bought an NES game that didn't work, they had no problem letting you return it for what you wanted. Today its different. You can't return it for something of equal value either. WTF gives with that? Since they're taking the game back because its a piece of [censored] I don't see why they don't allow you to get another game of equal value. Truthfully, you return it, they give you a brand new copy. It's basically wasting another $60 of their money to give you the same game. Why not let them have the choice to get another game of equal value that will not be returned? It wastes less money. They have to return games that have been cited as faulty. It's part of their guidelines.

my game doesnt out right freeze up, but it CONSTANTLY "hiccups", a slight 1-2 second freeze every minute or so on travel. its sooooo annoying.

I strongly suggest that if you decide to try and return it Aweless, that you just do it, in a sooner rather than later way. The longer you wait the less likely you are to get any kind of 'in store credit' or refund/exchange.

It happened with the Fallout 3 GOTY (Grift Of The Year) for PS3. Gamestop trade-in value after a week was $5.00 - $10.00 (because people just kept returning them), and after that the forum was littered with gripes about retailers refusing to take the game back at all. The response I got was that it was now between me and Bethesda to resolve it. Problem was the Canadian CE was the US region and the GOTY was CDN version.

The quickest fix for Bethesda would have been a direct exchange program, send us the disc we know (by their own admission) doesn't work and will send you the one that does. Instead it was the line that shall live in infamy. 'We are aware of the issue.... blah blah blah. Reads... please cross your fingers and hope we can patch it instead on just giving you a disc that we know will work. HORRIBLE. 13 months on, it still is a massively flawed patch job.

I had very few issues with the original FO3 for the PS3 system. The plain vanilla CE version worked. But Bethesda now has a shady rep for the 'ol' pump and dump' , hype the bejeezus out of it, take the pre -order money, (ps thanks for the money up front), please check back later for a patch followed by :cricket sounds:.

The good news is this is a new release, and the negative press, karma, bad reviews, whatever you want to call it is HUGE! So Betathesda is either going to have to crank out great patches in a timely manner (Borderlands was fixed in days BTW) or enter witness protection. I pre-ordered the CE of FNV hoping that it wasn't going to be a repeat of my last experience with Bethesda. But i have a dejavu sinking feeling in the pit of my stomach that i just lit $90 on fire, I haven't opened it... because if it ain't fixed by Monday (YES I EXPECT YOU TO WORK THIS WEEKEND)... it's going back as a full refund unopened return.

Yeah games are considered similar to software you'd buy for a PC. Once you open the package it's yours and that's it. It's all in the "end user license agreement". That why everything you buy for a PC always have updates (Windows, Adobe, etc). Because there are always bugs but never as bad as I've seen with this game. It took them what 2 years to come out with this and I bet they got a heard of testers and tech guys and nobody saw any of this before launch????? I just don't get it.

Anybody Else notice all the great games you play that have the fewest bugs are exclusive titles, so it boils down to the age old greed. Bethesda is trying to svck as much cash out off the pocket of the unsuspecting as they can. I really am thinking the PS3 version of Fallout New Vegas is a bad port. Uncharted 2, MGS4, Ratchet and Clank, Gears of War, and Half-Life where all excellent experiences I can't think of any real bugs of the top of my head. I'm thinking because each team/developers number 1 priority was to make a great remember-able experience, not the intent to insulate there house with cash. Give you there are rotten eggs like Halo which every version is buggy and worst part is Bungie punishes the costumers for finding them weather its intentional or not. I'll just bunch them in with Microsoft seeing as they are butt buddies with each other and Microsoft is the most efficient at being greedy its almost as if they intentionality make errors just to f with people.

I'm not saying Bethesda doesn't or is incapable of making great games I know they are way better then Bungie or Microsoft about making things right and enjoyable to there fans. I just wish they'd get most of the bugs that interfering with game play taken care off before releasing it. I really miss the days of PS and PS2 developers worked their butts off to produce as bug free a game as possible because they couldn't patch it so they'd loose there butts if something was wrong. Now they just want the money and will fix any bugs if they feel like it.

I would try to return it in your case, if your pissed enough they'll take it back. Two worlds was a piece O' crap, GameStop took it right back because I stormed in and it was a well know problem. I've also taken back Ace Combat 4 W/ Flight stick to game stop. Nothing wrong with the game but the stick was a POS it had drifting when your where at resting zero, I swapped copies of the game and stick about 3 times with no results so the manager just gave me my money back and I bought the regular addition.

ISSUES I HAVE

Freezing
Bodies popping in and out of walls/objects
Some random texture bouncing where it creates a jaggy in the landscape.
1 second freezes continually.

Last night I heard a weird nose coming from behind me I turned around to have the crap scared out of me, a giant scorpion bigger then the standard Giant Rad Scorpion came flying at me sideways about 25 feet above ground slammed into the giant ants I was butt kicking and continued to fly off into the distance over the mountains. Crazy stuff man especially since it was dead.

By the way thank you Bethesda for using "like" real guns in the game it makes it so much fun. No if the random freezing and chop can be fixed...

No I will always go quality before quantity. I've never been one to reside with greed, I know money truly has no value, I measure my wealth buy the friends I have not the size of my bank account.

Ok you are != to a company. Regardless of what people think companies are out to make money. While they may have good intentions of creating a fun game the main goal of creating a game is to make money. If this wasn't true then games would be free, or cost less just to cover development cost. Now excluding what is going on right now it is not greedy to maximize profits (it is if the game quality suffers). For example if my company develops a game for 3 consoles instead of 1 and it does well I can give my developers a bonus for doing a good job. How is that greedy? I could even increase the salary of my staff members or hire more.

Greed is an excessive desire to possess wealth or goods.

Key word is excessive. I measure my wealth by my ability to provide for the ones around me and not the amount of friends I have. To each his own.

Reading these forums, it just seems that I'm lucky I'm not experience the majority of problems posted so far

I will say that I HAVE had the game lockup my system twice over 20 hours of playtime but really didn't effect me much since I save often (with autosave only on for save on sleep and wait)

Having said that this game runs pretty smooth for the most part, there are moments the game will hiccup (no so much freeze for a split second but rather have a slight drop in framerate) from processing all the data that the game engine throws at the system

I'm glad they switched to a one-time start-up install instead of the the "caching" method they used for fallout 3 (that caused a lot of problems for some people)

That being said this game really uses the hard drive ALOT!

I will not that I did upgrade my PS3 harddrive recently to a Western Digital 320GB 7200RPM drive with a 16MB cache (not only bigger than the previous hard drive but faster as well)

Is it possible that the stock harddrives are having a hard time keeping up with game engine's demands? its possible

Even though it svcks what you guys are going through, my darker side is laughing inside because we are to blame here (well not me this time, lol), you buy this software fully knowing what happened to GoTY last time. I'm not planning to spent a dime on this until it functions properly. I can accept minor graphical glitches and other bugs for such a complicated game. But I'm not going through this freezing hell again! :nope:

I'm not planning to spent a dime on this until it functions properly. I can accept minor graphical glitches and other bugs for such a complicated game. But I'm not going through this freezing hell again! :nope:



Actually I rented Vegas :P and am/was planning on picking up Fallout 3 GOTY, but I've heard nothing but problems with freezing and DLC being unfinishable with the game crashing at certain points

In fact it's not the DLC's that are flawed. If you manage to finish FO3's DLC's before your save game hits 10 or 12MB then most of the time you're not subjected to fps drops/freezes, which you can imagine is nearly impossible if you want to explore everything in the Fallout world. Most problems I encountered regarding freezing was when my save game got over the 10MB threshold, I believe it's related to the RAM of the PS3 console which can not keep up the data processing but I'm not sure and it doesn't matter anyway. That's why I'll wait a while until you guys advance a bit further in FONV, I'll be interested to read what happens then.

Reading these forums, it just seems that I'm lucky I'm not experience the majority of problems posted so far

I will say that I HAVE had the game lockup my system twice over 20 hours of playtime but really didn't effect me much since I save often (with autosave only on for save on sleep and wait)

Having said that this game runs pretty smooth for the most part, there are moments the game will hiccup (no so much freeze for a split second but rather have a slight drop in framerate) from processing all the data that the game engine throws at the system

I'm glad they switched to a one-time start-up install instead of the the "caching" method they used for fallout 3 (that caused a lot of problems for some people)

That being said this game really uses the hard drive ALOT!

I will not that I did upgrade my PS3 harddrive recently to a Western Digital 320GB 7200RPM drive with a 16MB cache (not only bigger than the previous hard drive but faster as well)

Is it possible that the stock harddrives are having a hard time keeping up with game engine's demands? its possible


Kyle G., you read my mind. I've theorized this ever since reading all the problems other people were having. I've done the same thing, except with a Seagate 500GB 7200RPM drive and I've randomly crashed once in about 10-15 hours or so. A guaranteed crash for me is selling/buying multiple items with the bar tender at the Mojave Outpost (happened 3 times), but other than that I've just had the one crash along with the quick "freezes" every minute or so. I'm enjoying the hell out of this game too, I hope others can someday as well.
