There is a lot less guilt involved here though. In the event that they make me wait on a McDouble, it just makes me feel guilty for being too cheap to buy the McNuggets.

Just so people know, while DLC usually is available by 6 am, the Xbox marketplace doesn't officially update its dashboard, advertisemants and splash images until 7 am. So I think we can expect this to be sorted by 7 am (25 minutes) at the latest.

Nope, there have been BF3 updates in the past and that hasn't took Xbox live down.

The issue here is that people cannot connect to Xbox live.
