They are legally bound to the street date and yes they can make a lawsuit if they break it. There is actually examples of this happening and shops getting huge penalties!!!
There is a reason why you can't just walk into the store and get the game before its released, most often they have the game in stock atleast a few days before the release date!! I remember when EU3 came out, they had the game in on monday but ofc could not get it hime before friday! (guess why!!! release date)

Its not beneficial for Bethesda or any other dev for that sake, to have shops breaking the street date! why ? well because.
A. its illegal
B. its bad for advertising!
C. it makes the majority of costumers pissed (just look at this thread)
D. it makes release dates useless!
E. it might spawn soiilers bad impressions etc!
F. ETC


As I said before, if you are supporting the shop who breask the law, you are supporting a criminal act and you could actually get penaltied aswell (yes thats a fact)


So, to reiterate my OP, there is nothing intrinsically illegal or criminal about selling a game before the noted release date. IF, however, that retail chain has a contract with the publisher, that's a different matter. In the event a contract is violated, that's a civil manner, not a criminal one. Just to clear that up.

in regards to your individual point's, I'll respond to them individually.

a. this is circumstantial, and not always the case. but very likely its the case the majority of the time. its also not illegal so much as a breach of contract. which are different.
b. its only bad for advertising because retail stores want a static release date to begin with. if Bethesda marketed the game as "available November" and retail stores just sold it when they received it, the world wouldn't end.
c. uh, i think you have this backwards. the majority of pissed people on this forum are pissed because some stores broke the arbitrary street date while others arent. NO ONE would be upset if the GameStop that has their game was giving it to them regardless of the street date. i can promise you that. the only pissed people would be those who's pre orders haven't actually arrived at their retail store yet - which would be far less people then are upset currently.
d. they ARE useless to consumers. they are only useful to retailers because it puts them all (conceivably) on equal footing. so no store has it before others, stealing potential sales.
e. i have no idea what this means

The bank robber anology is completely flawed. I haven't stolen anything. Nor have the game retailers. They're simply offering me a product. A product I purchased with money I worked for.
No logical reason to release it earlier? If they release earlier people are less inclined to pirate the game. If they release earlier it could have competed with MW3, which was being sold en masse when I picked up my copy of Skyrim today. I had to wait in a queue for half an hour and was the only person who didn't get MW3. If they release earlier they please their customers earlier. More importantly, if they release earlier it has no negative repercussions for the developers at all.
I however, can not think of a single logical reason to enforce some arbitrary date.

How's this for an anology: You go to town to buy a toaster. Store A says you have to wait a week before they can sell you the toaster. Store B will sell it to you immediately, but it won't work for a week. Store C will sell you a working toaster. Which store do you go to? Laws are not applicable to the situation.
We're talking about a different thing. At the moment, X-box version is playable, PC version is not. This basically means that others can play the game while we wait. How can you say it's fair?
The release date is there to prevent such situations. I'm not entirely convinced it's the best solution, but, honestly, I don't see any better. You say they please their customers by releasing the game earlier. Who does? The shops? That's true. Bethesda? Not really. Their goal is to satisfy the greatest possible number of customers, the easiest way to achieve it is by making sure everybody gets the game on the same day. And that's exactly what fixed release dates are for.
Of course, they could allow the shops to start selling earlier. But then the release date would be replaced by "the date when we send games to the stores". There'll always be SOME fixed date.

Nah, we just have the decency to respect release dates. :P


But I think some stores here are selling it too, so it's not like this issue is only in Europe.

It drops in Sweden the 11th anyways. People might be able to get their hands on a console version now in some countries but the PC version won't be playable for anyone before the 11th. Stop acting like it has dropped in "Europe".

I work at a dutch gamestore called ''gamemania'' I had more then 25 people asking if they already could complete their pre-order. My colleague almost gave some away. but Luckily I was working at that time. My store is staying legit. Except all the Kids toys stores that are giving copies away already.

I take it you guys didn't receive the e-mail during the Modern Warfare 3 midnight launch that we're allowed to simply go ahead and sell it on the 8th? :|

But yeah, Game Mania NL and BE have both had it set for a November 10th release.

I have it right now, but I only get to rub the 'cloth' map against my face as Steam has it's typical release date check.

That's about 30 million out of over 700 million people that have a chance at getting it early for only PS3 and Xbox, most people still get it for PC afaik. I sure hope those retailers get hit with a massive lawsuit from Beth/Zenimax though. And wouldn't buy the game myself until 11-11-11 even if I could regardless :>

You people need to stop acting as if Europe is a country. Reading through this thread you would think you could pick Skyrim up anywhere in Europe right now.

Some European countries have broken the street date. Only some.

Here in the UK the game is not released for Console or PC until Friday.

I've checked pretty much every game shop including sites like amazon UK and all release on the 11th.

Although the European leaders would love for us to be a United European state. We are still independent. (for now)

I just got the pc version from a store in the Netherlands, but ofcourse can't play it untill 11/11/11. Nice map though :) better than the old OB map imo.

I'll let you in on a lil secret..... Those retailers all do it and they have been doing so for years and never have been sued. The main reason why bethesda might be upset by it, is because of their promotion and marketing plans. Close to release date you see typically large investments in promotion of their games. It's not nice to see it get spoiled like that. On the other hand... they probably won't sell less and it even gets media attention from regular news sites. So i really don't see the big issue here :P

How is revenge to compare Skyrim with one of the best selling (if not the best selling), more expansive, interactive, fun and graphically demanding (yes, you heard right You can push it so far any rig stutters!) indie game ever?
In fact, 360's owners are happy they're getting MC at all!
On the other hand, those who play it early will be visited by Sheogorath in their sleep and taken to the Isles for a month... just before being transfered to Molag Baal's realm :obliviongate:
